As our customer you provide us with important information about yourself. We believe it is our responsibility to safeguard your personal and financial information. "We," "our" and "us," when used in this notice, means one of the Bayview family of companies including those listed above.

When we use the words "you" and "your" we mean the following types of customers:

All of our consumer customers who have a continuing relationship with us, such as:
  • Someone with a mortgage loan with us.
  • Someone whose mortgage loan we service.
  • All persons (individuals) who do not have a continuing relationship with us but who may use a financial product or service we provide in isolated transactions.
    This includes, for example: Someone who applies for a loan that does not get completed.

We will tell you the sources for nonpublic personal information we collect on our customers. We will tell what measures we take to secure that information.

First we define some terms in connection with this privacy notice.

Nonpublic personal information means personally identifiable financial information about you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records.

An affiliate means a company that we own or control, a company that owns or controls us, or a company that is owned or controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control.

A nonaffiliated third party includes a company that is not an affiliate of ours.

Information We Collect to Conduct Our Business

We collect nonpublic personal information about you from the following sources:

  • Information about your transactions with us, our affiliates or others; and
  • Information we receive from a consumer reporting agency.

Information Shared Among Bayview Affiliates

We may share all the information we collect within our family of companies. For example, we may share:

  • Identification information (such as name and address).
  • Transaction and experience information (such as payment history).
  • Credit eligibility information (such as income and credit reports); and
  • Other information.

You may tell us not to share credit eligibility information among Bayview affiliates. Your choice will not affect the sharing of identification and other information permitted by law.

Nonpublic Personal Information We May Share with Nonaffiliated Third Parties

We do not disclose any nonpublic personal information about you to any nonaffiliated third party, except as permitted or required by law, including sharing with companies that perform marketing or other services for us or with whom we have joint marketing agreements.

Your Choice to Limit Marketing

You may limit the Bayview companies from marketing products or services to you based on your personal information that they receive from another Bayview company. This information includes your income, your account history with us, and your credit history. Your choice to limit these marketing offers will apply until you tell us, in writing, to change your choice. You do not need to opt out of receiving marketing offers from the Bayview family of companies each year, although you will receive an annual privacy notice from us. The election to prevent our affiliates from marketing to you based on information received from another Bayview company does not apply if you have an existing relationship with the affiliate.

The Confidentiality, Security and Integrity of your Nonpublic Personal Information

We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your nonpublic personal information.

Nonpublic Personal Information and Former Customers

We do not disclose nonpublic personal information about former customers, except as permitted by law.

Special Notice for Vermont and North Dakota Residents

We do not share your nonpublic personal information with affiliates or with non-affiliated companies except as allowed by law.

Special Notice for California Residents

In order to comply with California law, the following applies if your account has a California mailing address.

Restrict Nonpublic Personal Information Shared with Nonaffiliated Third Parties

Even if you do not make the privacy choice set out above, we will not share information that we have about you with nonaffiliated third parties, unless otherwise permitted by law.

We will not share information about you within our family of companies unless we first provide you with further privacy choices or unless otherwise permitted by law.

Updates and Additional Information

This notice replaces any previous notices from Bayview about the privacy, security and protection of information. For additional information regarding our Internet privacy practices, go to our website. We may amend this privacy notice at any time. We will inform you of changes as required by law.

IMPORTANT INFORMATION ABOUT CREDIT REPORTING

We may report information about your account to credit bureaus. Late payments, missed payments, or other defaults on your account may be reflected in your credit report.
